Terms of Service
Higher Calling, Arizona. These terms govern the public website, the staff portal and the mobile experience (together, the “platform”).
1. Acceptance of these terms
By creating an account, signing in, submitting an application, requesting staff, or otherwise using the platform, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the platform. If you use the platform on behalf of a facility or organisation, you confirm you are authorised to accept these terms for it. You must be at least 18 years old to hold an account.
Where a signed staffing agreement, rate sheet or Business Associate Agreement exists between us and a client facility, that agreement controls if it conflicts with these terms. Employment terms are set by your offer letter and employee policies, not by this page — nothing here creates an employment contract or guarantees hours, shifts or placement.
2. Accounts and account usage rules
- Accounts are issued by invitation only and are personal to you. Do not share your sign-in, passcode, biometric unlock or multi-factor device with anyone.
- Keep your contact details, licence numbers and credential documents accurate and current. Clearance and scheduling decisions rely on them.
- Use the platform only for your assigned role. Do not attempt to reach records outside the access your role grants.
- Clock in and out only for yourself, from the actual work site. Falsifying punches, locations, timesheets or signatures is grounds for immediate termination of access.
- Report a lost device, suspected account compromise or an unexpected sign-in alert to us immediately.
- You are responsible for activity that happens under your account.
3. Acceptable use
You may not use the platform for:
- Uploading, downloading, copying or forwarding patient information except as your role and a client facility's agreement require
- Exporting employee, applicant or client data for personal use, or to a competitor
- Sharing screenshots of records containing Social Security numbers, medical documents or client rates
- Scraping, reverse engineering, load testing, probing security controls or bypassing access limits
- Uploading malware, or content that is unlawful, harassing or discriminatory
- Using the platform to send unsolicited marketing to employees, applicants or client contacts
Key actions in the platform are logged with the user, timestamp and IP address, and clearance, onboarding and payroll trails are tamper-evident. We review these logs when investigating misuse.
4. Clearance, scheduling and pay
Workers must be CLEARED before they can be assigned to a shift. Credentials that expire place an account on hold automatically. Shift availability shown in the portal is an offer of work, not a guarantee — assignments can change or be cancelled by the client facility. Pay is calculated from approved timesheets; if a punch or timesheet looks incorrect, raise it before the pay period closes so it can be corrected.
5. Ownership
The platform, its software and its design belong to Higher Calling. Content you submit — applications, documents, messages and timesheets — remains yours, and you grant us the licence needed to operate the platform, staff shifts, run payroll and meet our legal and compliance duties.
6. Availability
We aim for continuous availability but the platform is provided on an “as available” basis. Maintenance, provider outages or connectivity problems can interrupt access. Keep a fallback: if you cannot clock in, contact your scheduler or the on-call line immediately so your time can be recorded manually.
7. Disclaimers
Except where the law does not allow it, the platform is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. The platform supports clinical care operations; it is not a medical device, does not provide clinical advice, and must never be relied on for patient care decisions or emergencies. Verification results returned by third-party background, licence and E-Verify providers are theirs, not ours.
8. Limitation of liability
To the maximum extent permitted by Arizona law, Higher Calling and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost shifts or business interruption, arising out of or relating to your use of the platform — even if we were advised such damages were possible.
Our total aggregate liability arising out of or relating to the platform is limited to the greater of (a) the amounts you or your organisation paid us for platform access in the twelve months before the claim, or (b) one hundred US dollars ($100). Nothing in these terms limits liability that cannot be limited by law, including wages properly owed to employees, gross negligence, wilful misconduct or fraud, or obligations under a signed Business Associate Agreement.
9. Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable legal fees arising from your breach of these terms, your misuse of the platform, or your unlawful handling of information you accessed through it.
10. Suspension and termination
We may suspend or terminate access immediately for a suspected security incident, a credential lapse, falsified time or documents, or a breach of these terms. You may ask us to close your account at any time; we retain employment, payroll, tax, clearance and audit records for the periods described in the Privacy Policy.
11. Changes, governing law and contact
We may update these terms; material changes are announced in the portal, and continued use after the effective date means you accept them. These terms are governed by the laws of the State of Arizona, and disputes are heard in the state or federal courts located in Maricopa County, Arizona. Questions? Email Rayiyi@calledtocareaz.com.
